The Commission compensated this Claimant's injury at the second tier of compensation. It is the County's position that the injury to the wrist (40% which amounts to 100 weeks) should have been compensated at the second tier of compensation. However, the injury to the back (10% which amounts to 50 weeks) should have been compensated at the first tier rate. It is the County's position that you cannot combine an award for a scheduled and unscheduled member to reach a higher tier of compensation. *The County filed a motion for summary judgment on this issue.
