Bethel filed a petition for administrative mandamus challenging the Council's denial of water and sewer category change. The County moved to dismiss. Motion was granted with leave to amend. Bethel amended original action to add counts sounding in mandamus and certiorari. Bethel also filed two more essentially identical actions. One has been consolidated with first action; County has moved to dismiss second action. In response, Bethel dismissed the non-consolidated action and has asked the court for a scheduling order that will establish the calendar for the case. Scheduling Order issued. Bethel has filed discovery requests. The County has responded to Bethel's discovery requests and has filed its own requests. County has filed motion for protective order to prevent depositions of County officials. Court granted motion. Parties filed counter motions for summary judgment. Court has scheduled hearing for December 28, 2007. Court verbally granted County's motion, ruling that Council decision was legal. Written order has been enrolled. Bethel filed an appeal.
