The Commission combined an award for a scheduled member (the foot) and a non-scheduled member (the neck) to reach the second tier of compensation. The County appealed contending that since the award to the neck was not a second tier award, it should have been paid at the first tier level. Circuit Court granted claimant's motion for summary judgement. County appealed to Maryland Court of Special Appeals.
