| Trial - Bench Trial for Defense | 6/4/2012 | May 31, 2012: The claimant's attempted to have a jury award her voc rehab benefits (reimbursement of college expenses). The claimant's attempt was unsuccessful. We filed a Motion for Summary Judgment on the day of the schedule jury trial. The purpose of the motion was to stop a jury trial from rendering a verdict on the merits since the Commission has never ruled on the merits for voc benefits. Each time the claimant sought voc benefits(this was the second attempt) the Commission denied same for lack of jurisdiction pursuant to Sanchez v. Potomac Abatement .The Court did not grant our Motion, however, it did not allow a jury trial to proceed as sought by the Claimant. The Court remanded the case back to the Commission on or about May 31, 2012 as follows: Order of Court(Mccormick,J) that the matter is remanded to the Worker's Compensation Commission for an evidentiary hearing on the issue of entitlement of vocational rehabilitation benefits, SUBJECT TO JURISDICTIONAL ISSUES PURSUANT TO SANCHEZ V. POTOMAC ABATEMENT, 424 MD. 701(2011); 198 MD. APP.436(2011), ENTERED. We can chalk this one up as a win. |
